OHV Guidelines

With the spring weather, we see more OHV’s on our streets. Be aware of the laws involved to avoid ticketing. For a complete description of the law, click here and go to Title 6 Section .08

The following is a summary of certain aspects of the law. It is not comprehensive.

Police Department

Operation of Off-Highway Vehicles on Public Streets:

Use on Public Streets: Off-highway vehicle use is authorized on public streets, excluding all state highways.
Causing an Annoyance Prohibited: An off-highway vehicle operator may not ride an off-highway vehicle in a continuous manner along public streets, causing annoyance to any citizen.
Permission from Landowner: No person shall operate or accompany a person operating an off-highway vehicle upon privately owned land of any other person, firm, or corporation without permission from the owner or representative. (Ord. 08-01-2010, 8-4-2010, eff. 8-5-2010)

6.08.030: All off-highway vehicles using the aforementioned streets shall be operated at all times in accordance with all applicable state, county, and city regulations and will not exceed fifteen (15) miles per hour. (Ord. 08-01-2012, 8-15-2012, eff. 8-16-2012)

6.08.060:

1. No person may operate an off-highway vehicle on any public land, trail, street, or highway designated as open to off-highway vehicle use or in a manner prescribed by Utah code unless the person possesses:
   • a. A valid motor vehicle operator's license, or
   • b. The appropriate safety certificate issued by the state of Utah pursuant to Utah Code Annotated section 41-22-30.
2. Persons age eight (8) through fifteen (15) years of age shall not operate an off-highway vehicle on any public street unless the person is under direct supervision with oversight at a distance of not more than one hundred feet (100'), within which visual contact is maintained, and advice and assistance can be given and maintained by an adult of at least eighteen (18) years of age.
3. No person under the age of eight (8) years old may operate an off-highway vehicle on a public street.

6.08.080: No person under the age of eighteen (18) may operate an off-highway vehicle on public land unless the person is wearing a properly fitted and fastened U.S. department of transportation safety rated protective headgear designed for motorized vehicles use pursuant to Utah Code Annotated section 41-22-10.8.

6.08.090: Wherever possible, the off-highway vehicle will be ridden on the outside edge of the asphalt so as not to impede regular traffic. Off-highway vehicles will yield the right of way to normal motorized traffic.

6.08.100: Non-street legal off-highway vehicles may not be operated within city limits between the hours of thirty (30) minutes before official sunrise and thirty (30) minutes after official sunset.

Any person who violates any provision of this law is guilty of a class C misdemeanor.
