Small Claims

The Justice Court has jurisdiction over small claims cases if the defendant (person being sued) resides in Santaquin, Genola or Goshen, or if the debt arose within the city limits of one of these cities. Small claims can be filed for a claim up to $15,000. The claim must be for actual damages. The fee to file a small claims case is:

  • $60 (for claims that are $2,000 or less)
  • $100 (for claims $2,001 - $7,499)
  • $185 (for claims $7,500 - $15,000)

After the Affidavit and Summons is filed with the court, the plaintiff (the person filing the claim) is responsible to serve the defendant with notice of the suit and the trial date. It is the Plaintiff's responsibility to provide proof of service to the Court once it is completed. Payment must be made when the case is filed OR within 15 days of filing or the case may be dismissed.

Filing a small claims case in the Santaquin, Goshen or Genola Justice Court requires participation in Online Dispute Resolution.  Fill out the forms in the link below and provide them to the court. They can be submitted through mail (a return address and postage must be provided), email, or brought to the court window during business hours.

Exhibit Instructions for a small claim case

If no agreement was reached in the ODR, facilitation portion of the Small Claim process, you will need to prepare for an in-person Trial and a Court date will be set. Please provide three hard copies of any exhibits you wish to submit as part of a small claims trial: one for the plaintiff, one for the defendant, and one for the court. Each copy must be numbered for easy identification during the trial. The court will not make copies of your exhibits, you must provide them yourself.
